Terms of Sale

By placing an order you are offering to purchase a product/ service on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with www.ugandane.com you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. UGANDANE retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be UGANDANE or may in some cases be a third party. Where a contract is made with a third party. www.ugandane.com is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

(a) Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

(b) Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

(c) Payment

Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorization being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been dispatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Variation

UGANDANE shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

Invalidity

If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise, please let us know if you have any complaints or comments.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and UGANDANE. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of UGANDANE.

 

SHIPPING POLICY

This policy applies to UGANDANE products for the most part since UGANDANE services are offered in person at the client’s premises or via the internet.

Turnaround time

All orders are shipped within 48 hours Monday - Friday 8am - 5pm. Delivery is within 14 working days.

UGANDANE via Post Carriers

Ugandane uses any or a collaboration of the carriers whichever is within the clients' proximity, to deliver our orders:

Order Tracking

In mosts cases, a tracking number # is provided by the shipping carrier which Ugandane uses to update the client's order with the relevant tracking information. However note that some orders may not have tracking numbers. Regardless of whether or not a tracking number is availed to us, our turn around delivery time will not exceed 14 working days (Monday-Friday)

Shipping Rates

The rate charged for the shipping of the client's order is based on the weight of the client's products, and location. Before the final checkout page, the cost of shipping be shown to the client which ideally covers all expenses regarding tracking number and fast delivery.

Back Orders

If an item is back ordered, Ugandane will ship the client the portion of the order that is in stock. When the item is availed to us, which takes approximately 14 working days, Ugandane will ship the client the rest of his/her/their/its order. Clients will not be charged any additional shipping and handling for the second shipment.

 

PAYMENT POLICY

Accepted Methods of Payment

Ugandane's paypal gateway comes integrated with ecwid's ecommerce portal which powers Ugandane's webshop. Below are all the accepted methods of payment.

Debit/Payment/ Credit Card Charges

The client's credit card will be charged on order placement. If Ugandane is unable to fulfill the client's order for any reason then a refund is executed in the client's favor. Refund charges shall be at our expense in case we are unable to deliver in which case the client gets the full amount paid. However in the case of returned goods, charges shall be deducted from the initial amount paid by the client.

RETURNS, REFUNDS AND EXCHANGES POLICY

Returning an Item

The item(s) to be returned must be in their original unused condition unless the item production defect. The client must return the item within 7 working days upon delivery of item(s).

1. Please email us on our contact us page or at srockie@ugandane.com to request a refund. Returning postage is at the client's expense.

3. Include in your package a signed letter stating the reason for your return and the original receipt.

Return Exceptions

Some items cannot be returned if they are opened or consumed. These include services, drinks, music, videos or any goods that fall under such categories. Merchandise that has been worn, used, or altered will not be accepted for return or exchange.

Restocking Fee

All items are subject to a 15% restocking fee, which will be deducted from the client's refund. Ugandane does not refund the original shipping and handling paid on the order placement.

Exchanges

If the item(s) are in like new condition, then the client may exchange the items for a different size or color. Clients will not be subject to a restocking fee in this case, but will still have to pay return shipping.

PRIVACY POLICY

This policy covers how Ugandane use your personal information. Ugandane SERIOUSLY considers clients' privacy and takes into effect all measures to protect client personal information.

Information Collected

Ugandane collects information required to ship clients' orders. This includes:

Shipping Address

Email Address

Credit Card Information (encrypted and managed by the paypal portal)

Ugandane's service providers also remotely collect information on clients' IP address, browser type, and Refer URL data to prevent hacking attempts, help ugandane service providers know what web browsers people are using, and find out where Ugandane visitors are located so as to improve Ugandane's marketing.

How Clients Information is used

Clients' information is only used to fulfill client orders. Ugandane does not sell or redistribute client information to ANYONE.

Security and Storage

The only client information stored on our server is your order data billing, shipping, and order contents data powered by ecwid , awardspace and google. This information is encrypted using a Secure Sockets Layer before it is transmitted over a web server. We do not store your Credit Card data which is remotely executed managed by paypal.

Cookies and Browser Information

Cookies are small files that reside on clients' computers and allow Ugandane to recognize a client on their next visit or store client's shopping cart contents. Ugandane's ecwid store only uses this to track information.
